Article 83 of the Constitution is one of the principles on which supplementary laws and regulations have not yet been adopted, and its definition and criteria for measurement are still unclear. According to this principle, government buildings and property that are in the category of national treasures cannot be transferred without the opinion of the Islamic Consultative Assembly. Cultural heritage administrators have at times decided on three approaches: "experimental", "community" and "relying on world records". Decisions made about these treasures, due to the lack of a proper mechanism for recognition and assignment, can lead to the destruction of the original or part of the works. This qualitative study provided the possibility of answering the research questions by using library studies and interviews and by snowball sampling method after conducting 21 interviews and using the detailed parliamentary debates on Article 83. This study summarizes the definition of national luxury and unique luxury and suggested that inter-agency committees be formed to identify national wealth in order to provide the basis for decision-making without orientation and conflict of interests. Also, the scope of Article 83 of the Constitution to include non-governmental property and the protection of the owners of these treasures or the purchase of national treasures by the government.
